TERMS[JL1] CONDITIONS OF AGREEMENT FOR MPLOTI PLATFORM

This agreement is made on BETWEEN PROPERTY REALITY COMPANY LIMITED of (or whose registered office is situated at) PRC CENTRE WETSLANDS-DAVID OSIELI ROAD. (hereinafter called "the Company") of the one part AND “THE CLIENT” of the other part.

WHEREAS the COMPANY is desirous of ........................................................ HEREIN called the services on the Service providers mobile land purchase platform known as ‘ MPLOTI’.

AND WHEREAS the SERVICE PROVIDER is desirous of advancing the services of mobile land purchase platform Mploti:

NOW IT IS HEREBY AGREED AS FOLLOWS:

  1. Acceptance of terms
  • In order to access any of the services available on the Platform you will be required to accept these terms and conditions. You will be deemed to have accepted these terms by:
  • Viewing, accessing or using content on the mobile platform which does not require registration.
  • All customer payments shall be made through the official PRC Company’s pay bill number that is 913950
  • Customers will keep and maintain the Mpesa confirmation text message as prove of payment of the purchase price and shall provide the same as requested from time to time and in case of a dispute.
  • For monthly payments, you have a maximum of 5 days after the due date within which you are required to have regularized your account.
  • For weekly payments, you have a maximum of 2 days after the due date within which you are to regularize your payments.
  • Full payment of the deposit amount is mandatory requirement for you to be allocated a plot number, certificate on ownership and thereafter preparation of a sale agreement in your name. However, In the instance non-payment of full deposit amount, the client will be temporarily allocated a plot number which is subject to its availability and full payment of the deposit amount’s full threshold.
  • In case of a refund, all the money paid will be refunded to the customer less 10% of the purchase price and upon issuance of a 30 day written request.
  • Any missed installment shall attract 5% penalty on the installment amount. Any 3 consecutive missed installments shall be considered as adequate grounds for release of the plot (s) to the market for resale and refund process as indicated above shall be applied.

The Services

3.1 Eligibility

This Service is open to all MPLOTI Clients

3.2 Eligible Mploti customers will have access to a range of specific products and services including but not limited to:

1. Account statements

2.Customer care and support

5. Other products and services that will be added at the discretion of PRC LIMITED.

You agree to use the Services only for purposes that are permitted by:

(i) these terms and

(ii)any applicable law or regulation.

Cost of using the services

The service is charged at Ksh 1.00 per SMS and it’s the obligation of the client to ensure they have enough airtime on their phone to use this service.

The service is currently only available to Safaricom users and Mpesa payment platform.

9.2 Cost and Charges

PRC will currently not charge you to sign up/register for the Services.

However, PRC reserves the right to charge for access or all of Services in the future, subject to a clear notice when accessing Services that are charged.

No Warranties

The company provides the mploti Services and Contents on the Site “as is” and makes no warranties of any kind, either express or implied with respect to the Service.

Liability

 We shall not be liable for any loss of use, profits or data or any indirect, special or consequential damages or losses, whether such losses or damages arise in contract, negligence or tort, including without limitation to the foregoing any losses in relation to:

  • Your use of, reliance upon or inability to use our Service and/or Content;
  • The deletion with or without notice or cause of any of your data or information stored on the Service;
  • Any loss of your data or material resulting from delays, non-deliveries, missed deliveries, service interruptions or a failure, suspension or withdrawal of all or part of the Service at anytime;
  • The removal from the Service of any material sent or posted by you on or via the Service and/or the blocking or suspension of your access to the Service or any part of it in accordance with these terms.

If you are dissatisfied with any part of the Service or with any of these terms, your sole and exclusive remedy is to discontinue using this Service.

General

16.1 PRC reserves the right to vary the terms and conditions of this  Mploti Agreement at any time by placing the revised terms and conditions on its websites http://www.prc.co.ke/terms-conditions.html and you will be deemed to have been bound by such variation by continuing to use the Services. You should periodically check the websites http://www.prc.co.ke/terms-conditions.html to make yourself aware of any variations.

16.2 The construction, validity and performance of these terms and conditions shall be governed in all respects by the Laws of Kenya.

16.3 If any provision of these terms and conditions are declared by any judicial or other competent authority to be void, voidable, illegal or otherwise unenforceable, such a term shall be amended or at the discretion of PRC it may be severed from these terms and conditions and the remaining provisions of these terms and conditions shall remain in full force and effect.

16.4 Except where these terms and conditions provides otherwise, the rights and remedies contained in it are cumulative and not exclusive to rights or remedies provided by Law.

Payments

  1. All customer payments are to be made through the official PRC Paybill number
  2. Customers will keep the Mpesa confirmation text as prove of payment and shall provide the same in case of dispute.
  3. For monthly payments, you have a maximum of 5 days after the due date to regularize your account.
  4. For weekly payments, you have a maximum of 2 days after the due date to regularize your payments.
  5. Fully deposit is required for a client to be allocated a plot number and the sale agreement prepared. In the instance where the deposit is not fully paid, the client will be temporally allocated to a plot number subject to its availability once deposit threshold is met.
  6. In case of a refund, all the money paid will be refunded to the customer less 10% of sale price 30 days upon request.
  7. Any missed installment shall attract 5% penalty on the installment amount. Any 3 consecutive missed installments shall be considered as adequate grounds for release of the plot (s) to the market for resale and refund process as indicated above shall come into action.

The terms and conditions on this document may be amended at the discretion of PRC
